According to the Changjiang Daily, the Wuhan East Lake High-tech Zone Court has heard a notable copyright dispute case, becoming the first case in Wuhan involving the protection of rights related to AI-generated images. The key point of the case is that Wang, as the creator of AI-generated content, successfully defended his copyright and received 4,000 yuan in economic compensation.

Copyright, Piracy

The incident began when Wang posted a note on the Xiaohongshu platform about the images he created using a "certain AI" app. According to statistics, this note received widespread attention, garnering 35,000 likes and 6,478 saves. However, a technology company in Wuhan used his created images in an advertisement on its Douyin account without permission.

During the trial, Wang stated that although the image was generated by AI software, he had to conceive the visual in his mind, continuously adjust keywords and parameters to control the generated effect, which reflected his intellectual labor and creative skills. The judge pointed out that according to China's copyright law, works must possess originality and be expressible in a certain form.

After the hearing, the court found that Wang's conception and aesthetic choices were fully reflected in the image, thus recognizing him as the legitimate author and copyright holder of the image. The technology company in Wuhan was found to have infringed Wang's right to disseminate information on the internet by using his work without authorization, leading the court to order the company to cease the infringing actions and compensate Wang for economic losses and reasonable expenses totaling 4,000 yuan. After the judgment was issued, neither party appealed, and the case has become effective.

This ruling not only secured Wang's rightful interests but also provided important legal reference for copyright issues concerning AI-generated content, clarifying that AI-generated works meeting certain conditions are also entitled to copyright protection.
