On December 12th, the Beijing Internet Court convened a five-member collegiate bench for the first time to publicly hear the nation's first case of "AI voice infringement." The plaintiff, Yin某某, who works as a voice actor, has recorded multiple audio works. Yin某某 unexpectedly discovered that his voice had been AI-transformed and was being sold under the name "Mo小璇" on an app called "Magic Voice Studio." Therefore, Yin某某 sued the operating entity of "Magic Voice Studio," Beijing Xiaowen Intelligent Technology Co., Ltd., and four other defendants at the Beijing Internet Court, alleging that their actions infringed upon his voice rights. The plaintiff believes that the dubbing works using his voice have been widely circulated on apps such as Douyin and Zhibarb, with Douyin user "Xiaohe Kanju" having released 119 works using the plaintiff's voice since September 7, 2021. Through voice screening and tracing, it was found that the voices in these works came from the "Magic Voice Studio" app operated by Beijing Xiaowen Intelligent Technology Co., Ltd. Defendant Zhongguang Yingyin (Beijing) Culture Media Co., Ltd. handed over the audio recordings of three books that the plaintiff had recorded to defendant Microsoft (China) Co., Ltd., which then processed the plaintiff's voice through AI and authorized its sale to defendants Shanghai Blue Cloud Network Technology Co., Ltd. and Beijing Xinnuo Times Technology Development Co., Ltd. However, the plaintiff has never authorized any third party to AI-transform and sell his recorded voice. The above defendants' actions have severely infringed upon the plaintiff's voice rights and should bear the responsibility of ceasing infringement, apologizing, and compensating the plaintiff for economic and emotional damages. All five defendants deny the infringement. Beijing Xiaowen Intelligent Technology Co., Ltd. claims that the voice products in its app have a legal source, coming from Microsoft (China) Co., Ltd. Microsoft (China) Co., Ltd. states that the voices it used originated from Zhongguang Yingyin (Beijing) Culture Media Co., Ltd. Zhongguang Yingyin (Beijing) Culture Media Co., Ltd. believes that it had a collaboration with the plaintiff, with the agreement that the copyright of the works formed through the plaintiff's recordings belongs to it. Shanghai Blue Cloud Network Technology Co., Ltd. and Beijing Xinnuo Times Technology Development Co., Ltd. argue that they are the platform operator and distributor of Microsoft China's products, respectively, and do not constitute infringement. The plaintiff, in the final statement, believes that the factual basis of the lawsuit is infringement of personal rights, not copyright infringement, and that the defendants' authorization of the plaintiff's copyright should not be assumed to automatically grant authorization of the plaintiff's personal rights.
